On Behalf of | Nov 9, 2018 | workers' compensation

Many workers in the United States are aware that they can make a claim for workers’ compensation after being injured at work. Becoming injured because of a fall or because of faulty machinery are situations that are quite obviously eligible for workers’ compensation claims.

However, some instances can be less obvious. For example, if you contracted an infectious disease and you believe that you acquired it in the workplace, you may be unsure whether you will be able to make a claim.

How are occupational diseases defined?

In order to make a workers’ compensation claim after contracting a disease, it must be classed as an occupational disease, since “ordinary” diseases are not covered. In general, the disease must be directly related to the occupation you hold.

How can I prove that I contracted the disease at work?

Often, you can show that you contracted the disease at work if other workers are also suffering from the disease. You may also be able to prove that the working conditions, such as dusty or smoky environments, made the condition worse. If you are a medical professional, you may be able to show that you contracted a disease after being stuck by a contaminated needle.

What damages can I recoup?

If you make a successful workers’ compensation claim, you will be able to recoup damages for the lost wages you suffered while recovering from the illness, as well as medical bills. If you want to make a successful workers’ compensation claim, it is important not to waste time and take swift action.
